1. Agreement to Terms

Welcome to Rusty Rails, operated by Rustworks LLC, an Arizona limited liability company. These Terms of Service ("Terms") constitute a legally binding agreement between you and Rustworks LLC ("we," "us," or "our") governing your access to and use of our website, game servers, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

2. Account Registration

2.1 Eligibility

You must be at least 13 years old to use our Services. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

2.2 Account Security

You are responsible for:

• Maintaining the security of your Steam and Discord accounts used to access our Services
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up to date

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion.

3. Acceptable Use Policy

You agree NOT to:

• Harass, threaten, or intimidate other users
• Use offensive, hateful, or discriminatory language
• Cheat, exploit bugs, or use unauthorized software or modifications
• Impersonate others or misrepresent your affiliation
• Share or distribute harmful, malicious, or illegal content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Engage in any form of spam, advertising, or commercial activity without permission
• Interfere with or disrupt the Services or servers
• Violate any applicable laws or regulations
• Share account credentials or allow others to access your account

4. Game Server Rules

4.1 General Conduct

When playing on our Rust servers, you must:

• Respect all players and staff members
• Follow instructions from server administrators and moderators
• Use appropriate language in all communications
• Report bugs and exploits rather than abusing them

4.2 Prohibited Actions

• Hacking/Cheating: Use of any third-party software, scripts, or exploits
• Racism/Hate Speech: Any form of discriminatory or hateful communication
• Doxxing: Sharing personal information of others without consent
• Griefing: Intentionally ruining other players' experience
• Excessive Raiding: Targeting the same player/group repeatedly to prevent gameplay

4.3 Enforcement

Violations may result in warnings, temporary bans, or permanent bans depending on severity and frequency. Ban decisions are made at staff discretion and may be appealed through our Discord server.

5. Virtual Items and Currency

Any virtual items, currency, or rewards obtained through our Services have no real-world value and cannot be exchanged for cash or other items of value.

We reserve the right to:

• Modify, remove, or add virtual items at any time
• Reset or wipe server progress as needed for maintenance or updates
• Revoke items obtained through exploits or violations of these Terms

All purchases and donations are final and non-refundable except where required by law.

6. Intellectual Property

6.1 Our Content

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, and software, are owned by Rusty Rails or our licensors and are protected by intellectual property laws.

6.2 User Content

By submitting content to our Services (e.g., chat messages, forum posts), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating the Services.

6.3 Third-Party Content

"Rust" is a trademark of Facepunch Studios Ltd. We are not affiliated with, endorsed, or sponsored by Facepunch Studios. All trademarks are property of their respective owners.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Services will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Services are free of viruses or other harmful components
• Results from use of the Services will meet your requirements

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUSTWORKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Rustworks LLC and its officers, members, managers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another party.

10. Dispute Resolution

10.1 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally by sending a written notice describing the facts and basis of the claim.

10.2 Arbitration

If we cannot resolve the dispute informally, any dispute will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

10.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis and not as a class action, class arbitration, or representative action.

11. General Provisions

• Severability: If any provision is found unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
• Assignment: You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
• Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Services.
